“The Ground Systems Engineering Department at ESA/ESOC is willing to procure Intellectual Property Rights (IPR) and licensing management services from highly qualified and experienced companies in this matter in the domains.Location: Partially On and Off-siteKick-Off date: second quarter 2021Specificities: Service provision type of work, paid under FFP conditions.The scope of this procurement covers the provision of technical support to the Intellectual Property Rights and Licensing management activities of the ESAGround Systems Engineering Department to ESOC and ESA.Reference is made to the official Ground Systems Engineering licensing portal for further details.http://www.esa.int/Our_Activities/Operations/Ground_Systems_Engineering/ESA_operations_software_-_licensingThe requested services shall remain at technical level and are not meant to cover any legal aspects of copyright law. Nevertheless, license terms and conditions of applicable Free and Open Source Software (FOSS) and Commercial Off The Shelf (COTS), both referredto as “Third Party Products (TPP)” in the following, their compatibility, their obligations and implications, as well as their compliant implementation to allow their distribution by ESA (in terms of software package and/or source code snippet) shall be considered as part of the scope of the activities falling under the responsibility of the Service Provider. The detailed description of the tasks to be rendered and associated deliverables is as follows:Workpackage 1: Source Code Analysis- Connection to ESA Source Code Scanning tool- Scanning of source and/or binary screening- Analysis of the Code Scanning Results- Provision of a Code Analysis Report including actions to render the software licensable according to the needs- Follow up of actions with the developer until the software is rendered licensable according to the needsWorkpackage 2: TPP Analysis- Update of the TPP Database- Support to the definition of TPP Baselines- Review of TPP List with implementation guidelines (Bill of Material)- Provision of TPP implementation analysis results with recommendations to the developer- Provision of TPP implementation analysis reportsWorkpackage 3: Licensability Analysis- Provision of both WP1 and 2 services- Provision of software package licensability assessment and recommendationWorkpackage 4: IPR and Licensing Tools and Processes- Maintenance and operations of the IPR and Licensability Management Framework (hardware, software, configuration, update, migration…)- Sustaining and enhancement of the IPR and Licensability Management Framework- Update of lists and databases- Provision of support and training on IPR and Licensing matters- provision of IPR and Licensing management metricsWorkpackage 5: Consultancy support
